Acceptable Use Policy

This Acceptable Use Policy (“Policy”) supplements our Terms of Service (“ToS”) and Privacy Policy and governs your usage and access to the Software and Services provided by Pinkfish AI, Corp. ("us", "we" and "our"). Your continued use of our Software and Services constitutes your acceptance to the terms of this Policy.

For the purposes of this Policy, capitalized terms used and not defined herein shall have the same meaning ascribed to the terms under the ToS.

1. Usage Restrictions
   
   1. Save to the extent expressly permitted under the ToS or required by applicable law, any license granted by us to you under the ToS shall be subject to the following provisions. You must not, directly or indirectly, or permit any third party to: 
      
      1. breach any law which may be applicable to the use of Software and the Services;
      2. sub-license, sell, resell, assign, rent, lease, loan, supply, publish, distribute or redistribute the Software or otherwise make available the Software except as expressly permitted under the ToS;
      3. create multiple accounts in order to circumvent any of our Services or service limitations or restrictions.
      4. copy, alter, edit, create derivative works or adapt the Software or modify any portion of the Software to remove or circumvent technical limitations of the license; 
      5. decompile, disassemble, decode, de-obfuscate or reverse engineer, or attempt to decompile, disassemble, decode, de-obfuscate or reverse engineer, the Software or any component thereof;
      6. remove any proprietary notices, labels, or marks on or in any copy of the Software or any product in which the Software is embedded or use the Software or the Services in any manner or for any purpose that infringes, misappropriates, or otherwise violates any Intellectual Property Right or other right of any person, or that violates any applicable laws;
      7. use any ‘locked’ or key-restricted feature, function, service, application, operation, or capability without first purchasing the applicable license(s) and obtaining a valid key from us, even if such feature, function, service, application, operation, or capability is enabled without a key; 
      8. collect, use, hold and process the Customer Data without arranging all consents and approvals (including, in respect of any personal information, all necessary consents from the relevant individual) that are necessary;
      9. add any Customer Data in the Software that is or could reasonably be considered to be obscene, inappropriate, defamatory, disparaging, indecent, seditious, offensive, pornographic, threatening, abusive, liable to incite racial hatred, discriminatory, profane, in breach of confidence, in breach of privacy or harassing;
      10. access or use the Services in any manner that can threaten, plan, or otherwise facilitate violent activities that intend to or will cause physical harm to any person or property; illegally exploit minors or their image, likeness, or recordings; harass, intimidate, abuse, or discriminate against others based on race, ethnicity, national origin, sexual orientation, gender, gender identity, religious affiliation, age, disability, disease, or immigration status;
      11. distribute any key for the Software provided by us to any third party or otherwise use the Services or our Intellectual Property Rights for the benefit of a third party; 
      12. bypass any measures that we may use to prevent or restrict access to our Software or related Intellectual Property Rights (or other accounts, computer systems or networks connected to the Service) or attempt in any manner to circumvent limitations or security mechanisms established by us or other third parties such as our customers, developers, re-sellers, experts, integration and application partners (“Third Party”);
      13. use the Software to create, promote, or publish artificial or inauthentic engagement, review or other related content (Fake Engagements); 
      14. use the Software in any manner that extends or is broader than the uses purchased by you from us or an authorized Reseller, whether by creating multiple accounts or otherwise;
      15. generate and send unsolicited messages that you do not have permission to send or which are otherwise prohibited under applicable law (Spams); or
      16. disclose the results of testing or benchmarking of the Software to any third party without our prior written consent; 
      17. use the Service and Software to connect to the websites, applications, URLs, or IP addresses which are not authorized to be used by you; 
      18. access or use the Service and Software to adversely impact the availability of our Services, or those offered by a third-party;
      19. harvest, collect, or share the unauthorized personal information of individuals without their consent that may potentially expose them to any form of harassment, identity theft, loss of jobs, and other harm whatsoever; 
      20. create or pose a risk that can result in a denial of service attack on our Services or services of a Third Party; 
      21. create a security or service risk to us, our Services, or a Third Party or launch any malicious/cyber attack of any kind on us, Third Party or any other person; 
      22. use Services with the primary purpose of violating or circumventing the terms or restrictions of a Third Party. or 
      23. access the Software in order to build a similar or competitive product or service or use the Software in any manner other than as expressly provided herein.
2. Violation of this Policy
   
   1. We expect you to strictly adhere to the terms of this Policy while using the Software and the Services. Any violation of the terms set out above will constitute a material breach of this Policy and the ToS and we may initiate investigation and action, which may include immediate suspension or termination of your access to the Software and Services, as deemed fit in our sole discretion. 
3. Updates
   
   1. We can update the terms of this Policy at any time by uploading the latest policy on our website in replacement of the existing policy. We encourage you to check the website regularly for updates. 
   2. By continuing to use the Software and the Services after the effective date of the updated policy, you shall be deemed to have agreed to the latest Acceptable Use Policy. If you don’t agree with the modifications, your sole remedy is to cease using our Software and Services immediately.
